1. Introduction and acceptance
These Terms and Conditions ("Terms") govern your use of the Hire Your Style website (www.hireyourstyle.com.au) ("Website") and the hire of garments and accessories ("Items") from Hire Your Style ("we", "us", "our") to the customer ("you", "your").
By using the Website, placing a booking, or hiring Items from us, you agree to be bound by these Terms. If you do not agree to these Terms, you must not hire Items from us.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) ("ACL") or any other law that cannot lawfully be excluded.
2. Definitions
- "Hire Period" means the 7-day period described in clause 5, or such other period agreed with us in writing.
- "Hire Fee" means the fee payable for hire of the Items as displayed at checkout, in Australian Dollars (AUD) and inclusive of GST unless stated otherwise.
- "Bond" means the security pre-authorisation described in clause 9.
- "Fair Wear and Tear" means minor deterioration reasonably expected from normal, careful use of an Item, such as light creasing or minor pulls, but excludes stains, tears, burns, odours, missing components or damage requiring repair or specialist cleaning.
3. Eligibility
- You must be at least 18 years old to hire Items from us.
- You must provide accurate, current and complete information when placing a booking, and valid identification if we request it.
- We may refuse service, cancel a booking or decline a hire at our reasonable discretion, including where we suspect fraud, misuse or a breach of these Terms. If we cancel a booking for these reasons, any amounts you have paid for that booking (other than amounts you owe us under these Terms) will be refunded.
4. Use of the website and intellectual property
- You may use the Website only for lawful purposes and in accordance with these Terms.
- All content on the Website — including text, images, logos, product photography and branding — is owned by or licensed to us and is protected by intellectual property laws. You must not reproduce, distribute or use it for commercial purposes without our prior written consent. Third-party brand names (including designer labels such as Cazinc The Label and MOS The Label) remain the property of their respective owners.
- While we take reasonable care to describe Items accurately, colours may display differently on different screens, and sizing is based on the designer's specifications. Please review the sizing guide on each product page before booking.
5. Hire period
- The 7-day Hire Period begins on the date the Items are delivered to you (or collected by you, where applicable) and ends 7 days from that date, unless prior arrangements have been made with us in writing.
- Late returns will incur additional fees as set out in clause 8.
- All Items remain our property at all times. Hiring an Item gives you a right to use it for the Hire Period only, and you must not sell, sub-hire, lend or otherwise part with possession of any Item.
6. Booking and payment
- All bookings must be paid in full, or secured with a deposit where we offer this option, at the time of reservation.
- All prices are listed in Australian Dollars (AUD).
- Payment is processed securely through our payment provider. We do not store your full card details.
- A Bond applies to every hire and will be released or applied in accordance with clause 9.
7. Delivery, collection and risk
- You are responsible for ensuring correct sizing and suitability of the Items prior to the Hire Period, using the sizing information provided on the Website.
- Responsibility for the care and safekeeping of the Items passes to you upon collection or confirmed delivery, and remains with you until the Items are returned to us or collected by our courier.
- Items are shipped using our designated courier service. Once Items have been dispatched and are in the possession of the courier, we are not responsible for courier delays outside our reasonable control. If your Items do not arrive in time for your event or do not arrive at all, please contact us immediately — where a hire cannot proceed because of non-delivery, you will be entitled to a remedy in accordance with the ACL, which may include a refund.
- You must provide accurate delivery details. We are not responsible for non-delivery caused by incorrect information you provide.
8. Returns and late fees
- Items must be returned on or before the agreed return date, in the packaging provided. On the final day of your Hire Period, please place all Items back in the box provided and leave it out for courier pick-up as instructed.
- Late returns will incur a late fee of $10 per Item per day.
- If an Item is not returned within 7 days after the agreed return date, and you have not contacted us to make alternative arrangements, the Item may be deemed lost and you may be charged its full replacement value, determined reasonably by us with reference to the Item's recommended retail price, age and condition.
9. Bond and damages
- A valid credit or debit card must be provided at the time of hire.
- A pre-authorisation hold will be placed on your card as a security bond for the duration of the Hire Period: $50 where your order total is under $200, or $100 where your order total is $200 or more.
- The Bond (or part of it) will only be charged where reasonably necessary to cover:
- loss of, or damage to, Items beyond Fair Wear and Tear;
- additional cleaning required due to misuse (for example excessive staining, odours, make-up or fake tan);
- late return fees under clause 8; or
- other reasonable costs resulting from a breach of these Terms.
- If our reasonable costs exceed the Bond amount, we may invoice you for the difference, and you agree to pay that invoice within 14 days. We will provide you with an itemised breakdown of any amounts charged.
- The pre-authorisation will be released after the Items are returned and inspected, subject to your financial institution's processing times.
- Nothing in this clause affects your rights under the ACL.
10. Use and care of items
- Items must be used only for their intended purpose and handled with care.
- You must not alter, repair, pin, cut, or attempt to clean the Items yourself unless we instruct you to.
- Items must not be worn in hazardous conditions that could cause excessive damage or soiling (for example mud, paint, fire or smoke exposure).
- Please take care with make-up, fake tan, perfumes and deodorant, which can permanently mark delicate fabrics.
- You are responsible for the care, safekeeping and condition of all Items while they are in your possession.
- If an Item is damaged or stained during your hire, do not attempt to treat it — contact us as soon as possible so we can advise the correct treatment. Early notice often reduces or avoids cleaning and repair costs.
11. Cleaning
- Standard professional cleaning between hires is included in your Hire Fee unless otherwise stated.
- Do not wash, dry-clean or otherwise treat Items unless we instruct you to.
- Additional cleaning fees may apply for excessive staining, odours or misuse, in accordance with clause 9.
12. Cancellations, changes and refunds
- Cancellations made more than 24 hours before the start of your Hire Period may receive a full or partial refund, or a credit, depending on the circumstances and any costs we have already incurred.
- Cancellations made within 24 hours of the start of the Hire Period are generally not refundable, but we may offer a credit at our discretion.
- No refunds are given for change of mind, unworn Items, or unused hire days once the Items have been delivered or collected.
- This clause does not limit your rights under the ACL, including where Items are faulty, not as described, or the hire cannot proceed due to our failure to supply (see clause 13).
13. Faulty or incorrect items — your ACL rights
Our services and Items come with guarantees that cannot be excluded under the Australian Consumer Law, including that Items will be of acceptable quality, fit for purpose and match their description.
- If an Item arrives faulty, damaged, materially not as described, or the wrong Item is delivered, please notify us as soon as possible (and before wearing the Item, where practicable), with photos where relevant.
- Where there is a failure to comply with a consumer guarantee, we will provide the remedy required by the ACL. Depending on the nature of the failure, this may include a replacement Item, a repair, or a full or partial refund of the Hire Fee. For a major failure, you may choose between a refund and a replacement, and you may also be entitled to compensation for reasonably foreseeable loss or damage.
- Minor imperfections consistent with Fair Wear and Tear of previously hired garments, and which do not affect the wearability or appearance of the Item when worn, do not constitute a fault.
14. Liability
- Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the ACL or any other law that cannot lawfully be excluded, restricted or modified.
- To the extent permitted by law, and other than as provided by the ACL, we are not liable for: (a) any injury, loss or damage arising from your use of the Items, except to the extent caused by our negligence or breach of a consumer guarantee; (b) delays in delivery caused by events outside our reasonable control; or (c) any indirect or consequential loss.
- Where liability cannot be excluded but can lawfully be limited, our liability is limited, at our election, to resupplying the relevant hire service or paying the cost of having it resupplied, or refunding the Hire Fee paid for the relevant booking.
15. Communications (email and SMS)
- By providing your phone number and email address when booking, you consent to receiving service communications from us about your hire, including order confirmations, delivery updates, and reminders about the end of your Hire Period and return pick-up, by email and SMS.
- These service messages are part of providing the hire and are not marketing. We will only send you marketing communications if you have opted in, and you can unsubscribe from marketing at any time.
16. Privacy
- We collect, hold, use and disclose your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
- We collect your information to process bookings and payments, arrange delivery and collection, administer bonds, communicate with you about your hire, and comply with our legal obligations. We do not sell your personal information.
- Payment and delivery information is shared with our payment and courier providers only as needed to provide the service.
17. Events outside our control
We are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control, including natural disasters, courier network disruptions, strikes or government restrictions. If such an event prevents your hire from proceeding, we will work with you to reschedule, provide a credit, or refund amounts paid for the affected booking.
18. General
- If any part of these Terms is found to be invalid or unenforceable, that part will be severed and the remainder of the Terms will continue in effect.
- A failure by us to enforce any right under these Terms is not a waiver of that right.
- You may not assign your rights under these Terms without our written consent.
- These Terms, together with our privacy policy and any booking confirmation, constitute the entire agreement between you and us in relation to the hire.
19. Amendments
We may update these Terms from time to time. The version published on the Website at the time you place your booking applies to that booking. The latest version will always be available on the Website or on request.
20. Governing law
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Any disputes are subject to the non-exclusive jurisdiction of the courts of Western Australia.
